On February 21, 2005 Howard Morgan an off-duty cop was pulled over for driving on the wrong side of a one way street. According to the police officers accounts, “Morgan opened fire with his service weapon” when four white officers tried to arrest him, which caused them to shoot him 28 times.”
Morgan was lucky enough to survive the shooting, but his battle didn’t just end there. After being left for dead, he survived and was then charged with attempted murder of the four white officers who brutalized him. Morgan had been acquitted of the charges of aggravated battery and discharging a weapon at a police officer. Officer Morgan testified that he did not fire at the officers, saying that they had pulled him from his car, guns already drawn, and pinned him to the ground. He said they found his gun while he was trying to produce his police identification. Morgan also said he was complying with traffic laws. Unfortunately a jury found him guilty in a RETRIAL, a previous deadlocked attempted murder charge. Now, Morgan has been sentenced to serve 40 years in prison.
The jury of the retrial was NOT ALLOWED to hear that Morgan had been ACQUITTED of the other charges. Other FACTS and EVIDENCE involved in this case to support his innocence was; “Howard Morgan was never tested for gun residue to confirm if he even fired a weapon on the morning in question.”
Howard’s wife would go say this “If they can do this and eliminate double jeopardy and your constitutional rights, then my God, I fear for every Afro-American, whether they be male or female, in this corrupt unjust system.”
